Template Usage
Thank you for being a customer of JKC Website Design, LLC (“Company”). Once you purchase a template from Company, you (“Client”) will receive a link to your new template via an email invitation sent to the email address you specify during checkout. The template will be added as a new website on a free trial in your Squarespace Dashboard once you accept the invitation. This template will not be applied to an existing website.
With your Template purchase, Company grants one (1) exclusive, sub-licensable, non-transferable, license to use the template. You get one (1) copy of the template sent to you with each template purchase. If you want the template re-sent to you for any reason, you must purchase the template again.
If you want to build another website with the same template, you must purchase the template again. You may not share the template with any third party.
We are committed to sending your template within 48 hours, but please note that there may be an occasion where there is a delay on this time frame due to unexpected circumstances. Please email us if you have not received your template within 48 hours.
The Client may use the template for personal or business use. When the template is in your Squarespace Dashboard, it will no longer be updated or maintained by the Company. It is your responsibility to add your own content, images and personalize the site. Any changes you make to the template are yours to maintain going forward. Company does not make updates to your site once you have control of the template.
Liability & Guarantees
Company takes no responsibility for the suitability of the template, and it is not the responsibility of the Company to ensure you are satisfied with updates you make nor to ensure you make them correctly.
Company does not make any guarantees as to the results, including financial or other personal gains, of Client’s use of the template. Client agrees to take responsibility for Client’s own results with regard to using the template.
Your template will display in your Squarespace Dashboard on a free trial basis. If you let your free trial time period run, Squarespace may delete your website. It is not the responsibility of the Company to ensure you complete any edits to the template before the trial period expires. If your website gets deleted and you would like to receive another copy of the template, you will have to repurchase the template.
If you are nearing your free trial end date, you may either upgrade the trial to a paid service or request to reactivate the trial.
Refunds
Due to the digital nature of our templates being immediately accessible, no returns or exchanges are accepted and no refunds will be issued after the purchase is made. Please explore all template information before purchasing. If you have any template specific questions before you purchase a template, please get in touch.
Information Collected
By purchasing the template, Client may be asked to provide personal information including name, email address, mailing and billing address. Client agrees to allow Company access to this personal information for all lawful purposes. Client is responsible for the accuracy of the identifying information, maintaining the safety and security of identifying information, and updating the Company on any changes to this identifying information.
The billing information provided to Company by Client will be kept secure and is subject to the same confidentiality and accuracy requirements as Client’s identifying information indicated above. Providing false or inaccurate information, or using the template for fraud or unlawful activity, is grounds for immediate revocation of the license to use the template. Support
The Company provides 30 days of email support for its templates and installing them. The Company provides unlimited email support for bug fixes and help with template defects. Requests for customizations or changes to purchased items are not considered support, and you can submit a project request for such changes or customizations via our contact page.
The Company does not help with general Squarespace related questions. However, Squarespace has a library of help resources which you can find here. You can also subscribe to Squarespace Status Reports to be made aware of any outages.
Support does not cover template modifications, coding modifications, any problems that might arise from template or coding modifications, or any problems you are having with software.
If there are issues using a third party extension or custom code that was not provided by the Company, please contact that provider for support. The Company is not liable for third party integration and support.
We offer email support. A support request can be submitted to jackie@jkcwebsitedesign.com and we will respond within 2 business days, unless unexpected circumstances cause a delay.
Intellectual property
Whether you use the template purchased from JKC Website Design, LLC for your own personal use, your business, or as a website for a client, you are prohibited from claiming or promoting these designs as solely your own. You may not resell the design or claim the design as your own. You may not share the template, graphics, files or any design elements provided in your purchase with anyone else.
Any images provided with the template are for demonstration purposes only and are the copyrighted content of others (“Third Party Content”) that is used by the Company either by permission or under Section 107 of the Copyright Act as “fair use”. I respect the intellectual property of others and ask that you do the same. You must obtain permission from the owners of any Third-Party Content before copying, distributing or otherwise using those material, or you must replace these images with your own or source images yourself. We hold no liability for any image licensing or copyright issues that may occur through your unlawful use of the supplied images.
Template designs are exclusively owned and controlled by the Company and we own the rights to all designs (excluding third party images or premade licensed graphics) included in your template purchase.
You agree that your completed website design may be used in a template showcase, sales pages or on our social media for demonstration and promotion purposes.
